Assembly Bill 1261, Legal Representation for Unaccompanied Minors (Mia Bonta D-18), passed the California Assembly and Senate, and Felony Murder Elimination Project is asking our supporters to take some time this weekend to urge Governor Gavin Newsom to sign this important legislation. The bill would expand access to legal counsel, subject to the availability of funding, to every immigrant youth in California facing deportation in immigration court without a lawyer.
This legislation is especially critical at this moment as immigration crackdowns, spearheaded by the current presidential administration, are occurring all over the country, and especially in California. Unlike criminal proceedings, there is no federal right to a court-appointed attorney in immigration court, even for children. Funding for legal services for unaccompanied children has faced cuts and instability, leading to a crisis in representation for this vulnerable group, according to Acacia Center for Justice.
Children often lack the ability to understand the intricate immigration court system and their rights. Legal representation significantly increases the chances of a positive outcome for the child. Attorneys ensure children can participate in their cases, promoting fairness and upholding their rights.
Legal representation for unaccompanied children is primarily provided by nonprofit organizations and pro bono efforts, as federal law does not guarantee a court-appointed attorney for these children in immigration court. Organizations like Kids in Need of Defense (KIND), the National Immigrant Justice Center (NIJC), and the Children’s Immigration Law Academy (CILA) offer critical legal services, helping children understand their rights, navigate complex legal processes, and apply for lawful status to protect them from deportation and exploitation.
